Our main purpose is to provide student-athletes of all income levels an equal & affordable opportunity to get noticed by college coaches and recruiters thru our page. 643 SPORTS MGMT provides accurate and reliable information on how to manage the recruiting process, giving you the best opportunity to get recruited according to your athletic and academic talent level.
2. ELIGIBILITY
This is a binding agreement between you and 643 Sports. You must read and agree to these terms before using the 643 SPORTS MGMT Service. If you do not agree, you may not use the Service. You may use the Service only if you can form a binding contract with 643 Sports, and only in compliance with this Agreement and all applicable local, state, national, and international laws, rules and regulations. Our website is not directed to, or intended for, children under 13 years of age. 643 SPORTS MGMT understands that protecting the privacy of young children is important. For that reason, if a user under 13 years of age submits Personal information to our website, we have the right to delete such Personal Information as soon as we discover it was provided by a user under the age of 13 and we will not use it for any purpose. This Service is not available to any users previously removed from the Service by 643 SPORTS MGMT or any competitor of 643 SPORTS MGMT who is using the Services for reasons that are in conflict with the services provided by 643 Sports.
3. REGISTRATION
Subject to your strict compliance with these Terms of Use, 643 SPORTS MGMT hereby grants you limited permission to access and use the site. All permission granted under these Terms of Use is done so on a limited; terminable, revocable, non-transferable, non-exclusive, non-assignable, and non-sub-licensable basis and not sold. You have no other rights whatsoever to use the site, or portions thereof, including but not limited to its databases, linked pages, underlying code, or other intellectual property the site may contain. Your 643 SPORTS MGMT registration will grant you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. We may maintain different types of accounts for different types of Users:
(a) By registering for College Coach account, you must be currently employed by a NCAA Division I, II, III, NAIA or NJCAA institution as the head coach, assistant coach and/or official collegiate recruiter as an authorized representative of the entity with authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity’s behalf. Only actual collegiate coaches are permitted to register for 643 SPORTS MGMT College Coach account and, once your profile is certified it will include which institution you represent if not already included.
In the event the coach (College, HS and/or Travel/Private) with the foregoing authorization leaves the institution or organization, that (s)he created such account for, the coach will have (20) days to update the profile of the new institution, or organization, in (s)he will be participating including any data or User content that has previously been created or uploaded by such User. If the coach does not update (s)he profile 643 SPORTS MGMT would have the right to delete the profile after (20) days of being notified to update the account. 643 SPORTS MGMT has the right to request certification from an institution or organization regarding the validity or accuracy of the information provided by the coach.
(b) By registering for a Student-Athlete account, you must be in fact be a high school athlete (9-12 HS grades) or college student with an inherited account membership created while in HS. A parent or legal guardian over 18 years old needs to read and accept the terms & conditions before using your profile.
Each User will be assigned a username and password for access to use of the Services. 643 SPORTS MGMT reserves the right to change or update usernames and passwords in its sole discretion from time to time. You shall be responsible for ensuring the security and confidentiality of the usernames and passwords assigned by 643 Sports. By registering you agree (both coaches and student-athletes) to be fully informed of and abide by all rules and regulations set forth by the NCAA, NAIA, NJCAA, and any other organizations that govern high school, club and intercollegiate athletics that are applicable to your activities. You are solely responsible for compliance with these rules. Violation of any such rules and regulations are grounds of suspension and/or termination of the Service. 643 SPORTS MGMT is in no way affiliated with the NCAA, NAIA or NJCAA. You agree to absolve 643 Sport of any liability that may arise from your violation of these rules and regulations.
Members agree to only post accurate and truthful information in their 643 SPORTS MGMT accounts. 643 SPORTS MGMT is not responsible for any misrepresentation by either a Student-Athlete or Coach (College, HS & Club/Travel).
4. AUTHORIZATION OF USE OF WEBSITE
643 SPORTS MGMT hereby grants you permission to use the Website as set forth in this Terms of Service, provided that: (i) your use of the Website as permitted is solely for your personal, noncommercial use; (ii) you will not copy or distribute any part of the Website in any way without 643 SPORTS’s prior written authorization; (iii) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose; and (iv) you will otherwise comply with the terms and conditions of these Terms of Service.
In order to access some features of the Website, you will have to create an account. You may never use another’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You further acknowledge that 643 SPORTS MGMT has the right, in our sole discretion, to pre-screen, pre-approve, refuse and/or remove from our website, without prior notice, any User Materials, including without limitation User Materials that violate the Terms and Conditions.

6. TERMS AND CONDITIONS OF PURCHASE
Users shall pay in advance any service fees and other charges incurred by User at the rates in effect for the billing period in which those charges are incurred. For situations where credit card payment is utilized, User shall provide a current authorization for 643 SPORTS MGMT to debit Subscriber’s credit card account for such amounts. In addition, User shall provide 643 SPORTS MGMT with a current street address and Internet e-mail address for all communications and shall keep this contact information current. User shall pay all applicable taxes related to purchases by User. For situations where the User’s credit card issuing financial institution has been notified of a payment dispute, said User agrees that proof of Service usage by User constitutes User authorization to submit payment request to Credit Card issuing financial institution.
Cyber shoplifters (thieves who make legitimate purchases on the Internet with a valid credit card and then deny they placed the orders, or claim that the merchandise or service received is not what they expected) will be prosecuted. EACH OCCURRENCE OF A USER-INITIATED CREDIT CARD CHARGE-BACK (a sale reversal that occurs when a customer contacts his or her credit card-issuing bank or credit card company to request a refund for a purchase that they or someone else made on their credit card) WILL RESULT IN A $50 ADMINISTRATIVE FEE ASSESSED TO THE SUBSCRIBER’S ACCOUNT. 643 SPORTS MGMT may, in addition, at its sole discretion and without notice to the User, (a) suspend its performance under this Agreement and deny User’s access to and use of the Service until User is back in good standing, or (b) terminate this Agreement and User’s access to and use of the Service. 643 SPORTS MGMT will not provide a refund for any unused portion of the Services paid in advance by User.
7. COPYRIGHT INFRINGEMENT AND THE DIGITAL MILLENNIUM COPYRIGHT ACT
643 SPORTS MGMT respects the valid intellectual property rights of others. We will respond to allegations of copyright infringement with respect to content or materials on our website, including without limitation User Materials, in accordance with the Digital Millennium Copyright Act (the “DMCA”)

SUCH LIMITATIONS OF LIABILITY SHALL APPLY (A) WHETHER THE DAMAGES ARISE FROM THE SITE OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE (INCLUDING SUCH DAMAGES INCURRED BY THIRD PARTIES), AND (B) NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. IF YOU ARE DISSATISFIED WITH ANY PART OF THE SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DELETE YOUR PROFILE AND DISCONTINUE USE OF THE SITE.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION AND EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, UNDER NO CIRCUMSTANCES SHALL 643 SPORTS MGMT BE LIABLE TO YOU FOR ANY AMOUNT EXCEEDING TWENTY-FIVE DOLLARS ($25.00) OR THE MINIMUM AMOUNT ALLOWED BY LAW IN THE APPLICABLE JURISDICTION.
16. APPLICABLE LAW
The Terms and Conditions shall be governed by and construed under the law of Commonwealth of Puerto Rico, without regard to conflicts of laws rules. You agree that the courts of Puerto Rico shall have exclusive jurisdiction over the parties for all disputes. Venue shall lie exclusively and only in the commonwealth of Puerto Rico’s state and federal courts.
17. ARBITRATION
With respect to any and all disputes arising out of or in connection with our Services, the various services offered by 643 Sports, or these Terms and Conditions (including without limitation of Privacy Policy), 643 SPORTS MGMT and you agree to negotiate in good faith and undertake reasonable efforts to cooperate with one another in order to achieve a mutually satisfactory resolution. If you and 643 SPORTS MGMT do not resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by biding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury.
Any arbitration necessary under this section will be held through.
18. INDEMNIFICATION
You agree to compensate, defend, indemnify, and hold harmless 643 Sports, officers, directors, employees, agents, business partners, affiliates, distributors, licensors and licensees for, from and against all claims, losses, expenses, damages, costs, or demands, resulting from any claim, action, investigation, demands, resulting from any claim, action, investigation, demand, or proceeding arising in connection with your use of our Services or any violation of the Terms and Conditions.
19. SEVERANCE
Each provision of the Term and Conditions shall be construed separately and independently of each other and the invalidity of any one part shall not affect the validity of any other part.
